We have found that success in licensing patent portfolios requires experience, connections, and planning. Many companies think initially that they can license a patent portfolio simply by contacting a potential licensee or asking an attorney to contact one for them. After many shut doors, those companies come to us for our licensing experience, our connections to open doors for licensing negotiations, and our systematic process, in order to develop their portfolios and make them stronger for licensing. If you specifically seek advice on in-licensing, please also read our In-Licensing description.
Since 2002, we have helped many companies to license their patent portfolios. Our licensing clients range from start-up companies that have a handful of patents to Fortune 500 companies that have thousands of patents. We support them through the whole licensing process, from intellectual property (IP) development to licensing negotiations. Additionally, we have worked with over 300 clients through our consulting services since 1998 and, therefore, we have a large base of networks in every industry, to help open doors for licensing introductions.
Our well-proven licensing process consists of the following:
- For clients that have large patent portfolios, mining their patent portfolio, to identify strong candidates for licensing;
- Reviewing the client’s patent portfolio for licensing and assessing its strength and weaknesses;
- Developing IP, to build on and support the existing portfolio, in order to strengthen its licensing potential;
- Developing a licensing strategy, to determine to whom to try to license, the licensing price, and what else is for sale;
- Developing a financial model of the value of the patents for the potential licensee, which helps us understand what the key market drivers are and how to price the patents;
- Developing a PowerPoint® Presentation (ipStorySM) to communicate, in business terms, the value proposition of the license, including what the patents cover (at a claims level), how that is related to the potential licensee’s current or future business plans (including specific connections to the potential licensee’s patents and products), and the financial impact of that contribution;
- Contacting potential licensees, to set up initial meetings – we have thousands of contacts at hundreds of companies in all industries, as a result of our consulting work with over 300 clients since 1998;
- Facilitating initial meetings with potential licensees and pitching the value of the licensing deal on behalf of our clients; and
- Following up with potential licensees, to help to negotiate suitable terms, in order to close a licensing deal.
Let us help you be successful and get the highest value for your portfolio. This process for success is systematic, thorough, manageable, and efficient, but most of all, it gets results!
